Upcoming/Ongoing USEPA NAAQS Regulatory Initiatives
The US Environmental Protection Agency (EPA) has underway an unprecedented amount of regulatory activity under the Clean Air Act (CAA). Much of this activity is being driven by litigation by States and environmental groups to enforce deadlines and other requirements in the CAA. For example, in the last several years, EPA has substantially tightened the National Ambient Air Quality Standards (NAAQS) for PM2.5, lead, ozone, nitrogen dioxide (NO2), and sulfur dioxide (SO2). EPA has proposed even more stringent standards for ozone and plans to propose revisions to the secondary (welfare-based) standards for NO2 and SO2 and revised NAAQS for carbon monoxide (CO) and particulate matter in the next year. Each of these NAAQS changes sets off a chain of regulatory actions, including nonattainment designations (PM2.5 and lead), new source review (NSR) guidance, and State Implementation Plan (SIP) guidance and deadlines. The result is increasingly stringent and ever-changing controls and requirements on States and the regulated community.
The Environmental Protection Agency on August 2 published a proposed rule to curb interstate transport of power plant emissions from 31 Midwestern and Eastern states and the District of Columbia.

On September 13, 2010 Ohio EPA proposed to amend regulations under OAC 3745-502-02, -03, and -04 to revise requirements for collecting, remitting, and reporting state disposal and environmental protection fees, solid waste management district disposal and generation fees, and host community fees.
A proposed rule of the Ohio EPA amends regulations under OAC 3745-21-25 regarding control of volatile organic compound (VOC) emissions from reinforced plastic composites production operations.
Coal Combustion Residuals – The Regulatory Debate Continues
The Environmental Protection Agency is holding eight public hearings to collect comments on a proposal to federally regulate coal combustion residuals (fly ash, bottom ash, flue gas desulphurization sludge, and slag).
On September 8, the Environmental Protection Agency announced the availability of draft guidance for medical professionals on the handling of unused pharmaceuticals. The guidance, Best Management Practices for Unused Pharmaceuticals at Health Care Facilities, is targeted for hospitals, medical clinics, doctors' offices, long-term care facilities, and veterinary facilities and aims to keep the drugs from being discharged into water bodies.
